we wish to inform you that Legislative Decree no. 196/2003 of 30 June 2003, entitled “Code for the Protection of Personal Data” provides for the protection of persons and other subjects regarding the use of personal data.

Mr. Rinaldo Rinaldi, acting as data owner (according to art. 4 of the Code), uses the site as a means of taking of information about its products, even as a means of collecting personal data.

As indicated on the legislation, the processing of such data shall follow principles of correctness, lawfulness and transparency and protection of your privacy and your rights (according to art. 1 of the Code)

During your stay on the website, the owner’s information system will collect a series of technical data such as IP address, browser type, operating system, host and source URL. The holder may use this data in aggregate and anonymous form for his statistical analysis on website access.
Such data could not, however, be communicated to third parties, nor will be object of dissemination.
With regard to  the e-mail messages, the owner will proceed, in compliance with the code, to the collection of personal data (including the e-mail address) that you voluntarily submitted, taking care of its subsequent filing for purposes related only to existing  relationship.

The collection of data relates only to common data. The presence of any data classified as “sensible” (within the meaning of art. 4 of the Code) will imply the immediate destruction of the message, announcement or communication provided by users.
The data collected in the appropriate sections of the site may be communicated to other subjects in order to fulfill any requests. In such cases, consent will always be required, by filling in a box checked.

The visitor is made aware that data transmission over the Internet can not be considered bound to perform anything other than the correct application of safety standards required by the legislation in force.

Article 7- The right to access personal data and other rights
You have the right to obtain confirmation of the existence of personal information about you, even if not yet recorded, and their communication in intelligible form. You have the right to obtain information:
a) the origin of personal data;
b) the purposes and methods of treatment;
c) the logic applied in case of treatment with the help of electronic means;
d) the identity of the owner, the responsible and the representative appointed under article 5, paragraph 2;
e) subjects or categories of persons to whom the data may be communicated or who can learn about them as appointed representative in the State, managers or agents.

You have the right to obtain:
a) updating, rectification or, when interested, integration of data;
b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
c) certification that the operations in letters a) and b) have been notified, also as regards their contents, of those to whom the data were communicated or disseminated, unless the case where this requirement proves impossible or involves a manifestly disproportionate to the Law.

You have the right to object, in whole or in part:
a) for legitimate reasons to  the processing of personal data, even if pertinent to the purpose of the collection;
b) to the processing of personal data for purposes of sending advertising materials or direct selling or for carrying out market research or commercial communication.

Article 11 – Methods of data processing and data requirements
1. The personal data being processed are:
a. processed lawfully and fairly;
b. collected and recorded for specific, explicit and legitimate purposes and used in other processing operations that are compatible with such purposes;
c. accurate and, where necessary, updated;
d. relevant, complete and not excessive in relation to the purposes for which they were collected or subsequently processed;
e. kept in a form which permits identification of the person concerned for a period of time not exceeding that necessary for the purposes for which they were collected or subsequently processed.

2. The personal data processed in violation of the regulations governing the processing of personal data can not be used.

Article 13 -Information
1. The interested party or person from whom personal data are collected are informed orally or in writing:
a. the purposes and methods of data processing;
b. the obligatory or voluntary nature of data submission;
c. the consequences of a refusal to answer;
d. the persons or classes of persons to whom the personal data may be communicated or who may become aware of them as managers or agents, and the extent of dissemination of data;
e. the rights under Art. 7;
f. the identity of the owner and, where designated, the representative in the State pursuant to art. 5 and of the responsible. When the owner has designated as responsible, at least one of them, indicating the site of the communication network or the means by which it is easily known the updated list of those responsible. When it was identified as responsible for the interested party in the event of exercise of rights under Art. 7, this manager is indicated.

2. The information as per paragraph 1, also contains the elements foreseen by specific provisions of this Code and may not include elements already known to the person providing the information or knowledge, which may concretely hinder the performance by a public subject, of inspection or monitoring data for purposes of defence or of state security or the prevention, detection or repression of crime.

3. The Authority may issue a provision to set out simplified procedures as regards, as processing data, in particular, telephone services providing assistance and information to the public.

4. If personal data are not collected from the individual, the information referred to in paragraph 1, including the categories of processed data, is given to the data subject at the time of registration data, or when their communication is envisaged, no later than the first communication.

5. The provision as per paragraph 4 shall not apply where:
a. The data is processed on the basis of an obligation under the Law, on regulations or on legislation;
b. The data is collected for the purposes of carrying out the investigations defensive as per Law 7 December 2000  n. 397/2000, or however to assert or defend a legal claim, provided that the data are processed exclusively for such purposes and for no longer than is necessary;
c. the information to the interested involves a use of means that the Guarantor, by requiring any appropriate measures, declares clearly disproportional to the protected right, or is shown in the opinion of the Guarantor, impossible.

Under Article 13 of Legislative Decree no. 196/2003, we provide visitors with the following information:
The data supplied by the visitor will be used for the following purposes: commercial, administrative, promotional, the information on services, compliances of Law. The visitor must verify the correctness of his/her personal data and, where necessary, the rectification, updating or otherwise the modifying the wrong data.

Your data underwriting is optional, however a possible refusal of some of them could
result in the impossibility to continue every type of relationship (evade an order), since the data processing is essential to carry out law formalities.
The data will not be disclosed to third parties.
